Umpire warns of higher consent standards as ‘groping’ sacking upheld

The Fair Work Commission has warned workers there are now higher standards for physical interactions in the workplace after throwing out a veteran employee’s claim he was unfairly sacked for touching a female co-worker inappropriately as he squeezed past her.
Alcoa mechanical tradesman John Tamaliunas claimed his summary dismissal from the company’s Pinjarra alumina refinery in Western Australia for touching a colleague on the bottom was unfair, as any contact was unintentional and he had apologised soon after.
